Gibraltar is definitely part of the EU, but outside the fiscal area of
the EC (customs union). Just to remind the Spanish that Gibraltar is in
the EU and therefore that there should be freedom of movement between
Spain and Gibraltar, there are three flags at the British border post in
Gibraltar - Union Jack, Gibraltar flag (red and white) and the blue EU
flag. The Spanish only fly the Spanish flag on their side of the
border.

About Gibraltar; My opinion is that Gibaltrar is part of EU under
art.299 (previous 227), (4) of the EU treaty.
