CAPITULO VIII

Islas (artículos 44 al 46)



ARTICULO 44

Las islas existentes o las que en el futuro emerjan en el Río,

pertenecen a una u otra Parte según se hallen a uno u otro lado de

la línea indicada en el artículo 41., con excepción de lo que se

establece para la Isla Martín Garcia en el artículo 45.



ARTICULO 45

La Isla Martin García será destinada exclusivamente a reserva

natural para la conservación y preservación de la fauna y flora

autóctonas, bajo jurisdicción de la República Argentina, sin

perjuicio de lo establecido en el artículo 63.



ARTICULO 46

Si la Isla Martin García se uniera en el futuro a otra isla, el

límite correspondiente se trazará siguiendo el perfil de la Isla

Martín García que resulta de la carta H-118 a la que se refiere el

artículo 41. Sin embargo, los aumentos por aluvión de Martín

García, que afecten sus actuales accesos naturales a los canales de

Martín García (Buenos Aires) y del Infierno, pertenecerán a esta

Isla.

Islands (articles 44 to 46)



ARTICLE 44

The existant islands or those that shall emerge in the future in the
River, belong to one or the other party depending on which side of
the line indicated in article 41 they are located; with the exception
of what is established for Martin Garcia Island in article 45.


ARTICLE 45

Martin Garcia Island will be used exclusively as a nature reserve for
the conservation and preservation of native fauna and flora, under
the jurisdiction of the Argentine Republic, without prejudice of what
is estbalished in article 63.


ARTICLE 46

If Martin Garcia Island shall in the future unite with another
island, the corresponding limit shall be drawn following the coast(?)
of Martin Garcia Island shown in map H-118, to which article 41
refers. Nevertheless, increases of alluvium of Martin Garcia, that
affect their current natural accesses to the channels of Martin
Garcia (Buenos Aires) and of Infierno, will belong to this island.


so it sure is an Argentine island in Uruguay. No doubt. But article
46 kind of establishes a shifting border (the alluvium part).
