Mike,
I can possibly explain why New Jersey hasn't
asked for any part of Liberty Island. Simply, it
isn't worth it. For Ellis Island, they got something
like 80 to 90% of the island because It was increased
hugely. Not only does its territory has almost all
subsidiary buildings, also the main building is partly
on it. The economic implications are big. Ten feet
of land here and there which would end up parts of New
Jesey in Ellis Island just isn't worth it.
By the way, I believe the pier is old enough that
it is possibly exempted though I do not have the exact
history of the island nor the case on the boundary
with me.
