rereading the special masters report last night
i found pointed reference to 3 particular defense exhibits of usgs maps produced subsequent to the 1905 denj compact & likely pursuant to it
that would appear to have influenced the courts placement of the lower denj arc position
more than the compact itself
so i had to run back in here to check these out
 
& the most precise one of them turns out to be our old friend the 1931 topo of the 1926 survey sans artificial island
on which the arc strikes the left bank at 39d29m21s3
 
also 
tho the report doesnt refer to it in this connection
a plaintiffs exhibit of an 1887 geological survey of new jersey map revised in 1910 & showing the depa arc fully extended across dry new jersey has it exiting the left bank at 39d29m26s8
 
 
the 1935 judgment however
places that critical point as marked by monument 5
at 39d29m52s718
as you can also see at topozone
 
so thats still over half a minute or half a mile of unexplained shortfall of radius
 
now i could have missed something in all these volumes & volumes of data
but i dont think so
 
& i dont any longer believe the 1905 denj compact itself has any maps at all
 
so we may be closer to knowing how the lower denj arc position was arrived at
but there is still no clear source of its origination
 
hard to believe
but true
 
& so my new improved guess is
the left dimple of the mouth of the true alloways creek was selected as the arc location simply because all maps that show this arc 
even from colonial times
show it no farther north than that point
 
a deliberate minimalist judgment as it were by default
& for lack of anything better
 
 
of course i will have to keep scouring to try to substantiate this guess
but i am not sure i will be able to
nor can i explain why i cant or havent found any explicit basis for this adjudicated location
 
 
 
& hodgkins re depa was found & read in good order last night
& i will report more on that asap
