the interior bureau of indian appeals decision to hear an appeal of the
bureau of indian affairs decision to grant federal recognition to the
schaghticoke tribal nation came as no surprise to some of the
petitioners seeking the appeal

connecticut attorney general richard blumenthal filed the appeal
& the 13 neighboring towns joined the state
& 17 other parties filed a separate amicus curiae brief in support of
the action

if recognition is achieved
the tribe will be entitled to open a casino & succeed in its land
claims

the news is welcome but hardly surprising
blumenthal said tuesday

it enables us to move ahead

also noted the decision was exactly what was expected

a statement from her & the 2 other selectmen released tuesday said
we are very pleased with the ibia decision to hear the appeal
because it means that at the very least we will have a chance to argue
in a legal forum all the reasons why the schaghticoke tribal nation
should not have been given tribal nation status by the bia

the appeal is based on the belief that the bia decision disregarded key
legal standards that require evidence to be provided to show the
schaghticoke existed continuously as a distinct community & had
political leadership

the selectmen maintain that 4 criteria were met to warrant the appeal

there is new evidence that the decision is flawed

much of the evidence used by the bia fact finders was unreliable or of
little value
3
the research of either the tribe or bureau appears inadequate
& 4
there are reasonable interpretations of the evidence not considered
that could change the outcome

if there ever was any real doubt that these are real indians
the second article
which was the actual lead story of our local weekly paper
says

a territorial skirmish at the reservation has divided members of the
tribe & resulted in the arrest by state police of one of the chiefs
on charges of reckless endangerment & criminal mischief

the schaghticoke indian tribe chief was arrested by the state police
for allegedly hiring a contractor to pile 15foot high boulders in front
of the tribal pavilion & council office near the sacred burial grounds

his arrest on charges of 2nd degree reckless endangerment & 1st degree
criminal mischief came shortly after the chief of the schaghticoke
tribal nation received a letter from his cousin warning him & his
followers not to use the reservation any more

bond was set at 75000 wampum

each chief has followers & claims to be the true chief of the tribe
which was given federal recognition as a sovereign nation in january

the 400acre schaghticoke rezzie on the sylvan banks of the housatonic
river
falls under the jurisdiction of the state at this point

according to state police officers
the 2 factions of the tribe
the stn & the sit
are both entitled to use the property

the problem
according to the arrest affidavit
is that
both groups claim to be the rightful custodians of the property
& dont recognize the authority or validity of the other group

at russels arraignment
etc etc
