connecticut attorney general richard blumenthal filed the appeal<br/>
& the 13 neighboring towns joined the state<br/>
& 17 other parties filed a separate amicus curiae brief in support of <br/>
the action<br/>
<br/>
if recognition is achieved<br/>
the tribe will be entitled to open a casino & succeed in its land <br/>
claims<br/>
<br/>
the news is welcome but hardly surprising<br/>
blumenthal said tuesday<br/>
<br/>
it enables us to move ahead<br/>
<br/>
<br/>
the first selectman of kent<br/>
the town in which the rezzie is situated<br/>
also noted the decision was exactly what was expected<br/>
<br/>
a statement from her & the 2 other selectmen released tuesday said<br/>
we are very pleased with the ibia decision to hear the appeal<br/>
because it means that at the very least we will have a chance to argue <br/>
in a legal forum all the reasons why the schaghticoke tribal nation <br/>
should not have been given tribal nation status by the bia<br/>
<br/>
the appeal is based on the belief that the bia decision disregarded key <br/>
legal standards that require evidence to be provided to show the <br/>
schaghticoke existed continuously as a distinct community & had <br/>
political leadership<br/>
<br/>
the selectmen maintain that 4 criteria were met to warrant the appeal<br/>
1<br/>
there is new evidence that the decision is flawed<br/>
2<br/>
much of the evidence used by the bia fact finders was unreliable or of <br/>
little value<br/>
3<br/>
the research of either the tribe or bureau appears inadequate<br/>
& 4<br/>
there are reasonable interpretations of the evidence not considered <br/>
that could change the outcome<br/>
<br/>

members of task<br/>
an acronym for <br/>
town action to save kent<br/>
the grassroots group of kent citizens that has been working to thwart <br/>
efforts to open the reservation to development by casino funded <br/>
interests were also pleased with the ibia determination<br/>

now we will have a chance to demonstrate exactly how seriously flawed <br/>
the earlier decision by the bia was<br/>

which was the actual lead story of our local weekly paper<br/>
says<br/>

a territorial skirmish at the reservation has divided members of the <br/>
tribe & resulted in the arrest by state police of one of the chiefs<br/>
on charges of reckless endangerment & criminal mischief<br/>
<br/>
the schaghticoke indian tribe chief was arrested by the state police <br/>
for allegedly hiring a contractor to pile 15foot high boulders in front <br/>
of the tribal pavilion & council office near the sacred burial grounds<br/>
<br/>
his arrest on charges of 2nd degree reckless endangerment & 1st degree <br/>
criminal mischief came shortly after the chief of the schaghticoke <br/>
tribal nation received a letter from his cousin warning him & his <br/>
followers not to use the reservation any more<br/>
<br/>
bond was set at 75000 wampum<br/>
<br/>
each chief has followers & claims to be the true chief of the tribe<br/>
which was given federal recognition as a sovereign nation in january<br/>
<br/>
the 400acre schaghticoke rezzie on the sylvan banks of the housatonic <br/>
river <br/>
falls under the jurisdiction of the state at this point<br/>
<br/>
according to state police officers<br/>
the 2 factions of the tribe<br/>
the stn & the sit<br/>
are both entitled to use the property<br/>
<br/>
the problem<br/>
according to the arrest affidavit<br/>
is that<br/>
both groups claim to be the rightful custodians of the property<br/>
& dont recognize the authority or validity of the other group<br/>
<br/>
at russels arraignment<br/>
etc etc<br/>
