The issue is: King Marduk sees the CH-D border run on the south shore of the
lake. If the adjacent Swiss canton now expands into the lake - as has
happened - and if D does not protest, King Marduk can claim the new
territory for himself.
This as the question is concerned where the border actually is.

If there is doubt remaining a lawyer could also argue that Lake Constance
truly isn't a lake at all, but only an "enlargement" of the River Rhine. So
any CH - D agreement that says something about the border running midstream
or on either bank may be extrapolated to Lake Constance and used/interpreted
likewise. And as this is concerned it has something to do with the position
of the A - CH - D tripoint.
